By accessing or using Evoluna ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Evoluna. By creating an account or otherwise accessing the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement.

Evoluna is a personal development and accountability platform that provides:

• Weekly and daily planning tools
• Gratitude journalling and daily task management
• Social Path tracking to encourage meaningful social engagement

• Progress and statistics dashboards
• Subscription-based premium features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable.

3. User Accounts & Registration

To access most features of Evoluna, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, or if we reasonably believe that account credentials have been compromised.

4. Subscriptions & Payments

4.1 Free Tier

Evoluna offers a free tier with limited features. Free tier access may be modified or discontinued at our discretion with reasonable notice.

4.2 Premium Subscriptions

Premium subscriptions are billed on a recurring basis (monthly or annually, as selected). By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

4.3 Free Trial

Where a free trial is offered, you will not be charged until the trial period ends. You may cancel at any time before the trial ends to avoid charges.

4.4 Cancellations & Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. Refunds are not provided for partial billing periods except where required by applicable law (including the UK Consumer Rights Act 2015 and EU consumer protection regulations).

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law or regulation
• Transmit any harmful, offensive, or unlawful content
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service

You retain ownership of any personal data and content you submit to the Service (such as journal entries, task names, and goals). By submitting content, you grant us a limited, non-exclusive licence to store and process that content solely for the purpose of providing the Service to you.

7. Your Content & Data

You are responsible for all content you create within the Service, including tasks, journal entries, goals, and personal notes. You agree that your content will not violate any third-party rights or applicable laws.

We take reasonable measures to protect your data, but we cannot guarantee absolute security. Please refer to our Privacy Policy for details on how we collect, process, and protect your personal data.

For business continuity, disaster recovery, security, legal compliance, and incident response, we may create and retain temporary backup copies of Service data, including account records and user content. These backup copies are handled in accordance with our Privacy Policy and internal retention schedule.

We are not required to retain deleted content indefinitely, and we do not guarantee that any particular item of deleted or modified data will always be recoverable from a backup. If we provide a backup archive or data export to an authorised account holder or administrator, that recipient is responsible for securing the copy once it has been delivered.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
